In these terms, “we”, “us” and “our” refer to Diesel Daydreamer 3D Ltd trading as Tree & Sprocket. “You” and “your” refer to the customer.

  1. THESE TERMS

These terms apply when you purchase goods from treeandsprocket.uk.

Please read them before placing an order. By placing an order, you confirm that you accept these terms. Nothing in these terms limits the legal rights given to you under UK consumer law.

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order.

  1. OUR PRODUCTS

Tree & Sprocket products are produced on demand by our fulfilment partner after an order is placed.

We make reasonable efforts to display product descriptions, colours, artwork and measurements accurately. Colours may appear slightly different depending on your screen, and small variations can occur during printing.

Please consult the size guide before ordering. A sizing mistake does not affect your statutory right to cancel an eligible order, but you will normally be responsible for the cost of returning a correctly supplied item.

  1. PRICES AND PAYMENT

Product prices are shown in pounds sterling.

Delivery charges are calculated and displayed during checkout before you place your order. The complete amount payable will be shown before payment is taken.

Payment must be made using one of the payment methods available during checkout. Your payment information is processed securely by our payment provider. We do not receive or store your complete card details.

We may correct an obvious pricing or description error. If an error affects an order you have already placed, we will contact you and give you the choice of confirming the order at the correct price or cancelling it for a full refund.

  1. PLACING AN ORDER

Please check your order carefully before submitting it, including the product, size, quantity and delivery address.

After placing an order, you will receive an email acknowledging or confirming it. A contract is formed between you and us when we accept your order and send confirmation.

We may decline or cancel an order if:

• payment cannot be authorised;
• the product or required materials are unavailable;
• we cannot deliver to the address supplied;
• we reasonably suspect fraud or misuse; or
• an obvious pricing or product-description error has occurred.

If we cancel an order after payment has been taken, we will issue a full refund.

  1. PRODUCTION AND DELIVERY

Our products are made on demand. Production and estimated delivery information will be shown during checkout where available.

Delivery estimates are not guaranteed delivery dates, although we will take reasonable steps to deliver within the stated period. Unless another period has been agreed with you, goods will be delivered without undue delay and normally within 30 days of the contract being formed.

If an order is materially delayed, we will contact you where reasonably possible. Your statutory rights regarding late delivery remain unaffected.

Orders may be produced or dispatched from different fulfilment centres. We currently accept orders for delivery within the United Kingdom only.

Responsibility for the goods passes to you when you, or someone identified by you, takes physical possession of them.

  1. DELIVERY ADDRESSES AND UNCLAIMED ORDERS

You are responsible for providing a complete and accurate delivery address.

Please contact us immediately if you notice an address error. We cannot guarantee that an address can be changed after production or dispatch has begun.

If an order is returned because the address supplied was incomplete or incorrect, or because it was not collected, we may ask you to pay reasonable redelivery costs. This does not affect your rights where the failed delivery was caused by us or the carrier.

  1. YOUR RIGHT TO CANCEL

For most products purchased online, you may cancel your order without giving a reason from the date the contract is formed until 14 days after the day on which you receive the goods.

To cancel, you must clearly tell us of your decision before the cancellation period expires. You may email admin@treeandsprocket.uk or use the cancellation form at the end of these terms.

You then have a further 14 days to send the goods back.

Please contact us before returning anything so that we can provide the correct return instructions and address. Do not send goods directly to a Printful facility unless we specifically instruct you to do so.

  1. PERSONALISED PRODUCTS

The normal right to cancel does not apply to goods made to your individual specifications or clearly personalised for you.

Choosing a standard size, colour or existing Tree & Sprocket design does not, by itself, make an item personalised. This exception will only apply where you have requested an individual customisation, such as your own name, wording, image or bespoke design.

Your rights concerning faulty, damaged, incorrectly supplied or misdescribed goods continue to apply to personalised products.

  1. CHANGE-OF-MIND RETURNS

If you cancel an eligible order because you have changed your mind:

• you must return the goods within 14 days of telling us that you wish to cancel;
• you are responsible for the direct cost of returning the goods;
• you should obtain proof of postage; and
• you must take reasonable care of the goods while they are in your possession.

You may inspect an item as you would reasonably be allowed to inspect it in a shop. We may reduce a refund to reflect diminished value caused by handling beyond what was necessary to establish the nature, characteristics and fit of the item.

  1. REFUNDS FOLLOWING CANCELLATION

When an eligible order is cancelled, we will refund:

• the price paid for the returned goods; and
• the cost of our least expensive standard delivery option, where the whole order is cancelled.

We do not have to refund any additional amount paid for an enhanced or express delivery method.

We will issue the refund without undue delay and normally within 14 days after we receive the returned goods or receive evidence that you have sent them back, whichever occurs first.

Refunds will normally be made using the original payment method.

  1. FAULTY, DAMAGED OR INCORRECT GOODS

Goods must be of satisfactory quality, fit for their normal purpose and match their description.

If an item arrives damaged, misprinted, defective or incorrect, contact us as soon as possible at admin@treeandsprocket.uk. Please include your order number, a description of the problem and clear photographs where possible.

Depending on the circumstances and your legal rights, we may provide a replacement, repair, price reduction or refund.

Where goods are rejected under the short-term right to reject, consumers will normally have 30 days from delivery to exercise that right. Other remedies may remain available after this period.

We will cover reasonable return costs where goods need to be returned because they are faulty, damaged, misdescribed or incorrectly supplied.

Nothing in this section limits your rights under the Consumer Rights Act 2015.

  1. LOST PACKAGES

If your order has not arrived by the estimated delivery date, please contact us so that we can investigate with the carrier and fulfilment provider.

Where goods are lost before you take physical possession of them, we will remain responsible for resolving the matter in accordance with your statutory rights.

  1. PROMOTIONS AND DISCOUNT CODES

Promotional offers and discount codes may be subject to additional conditions, including expiry dates or restrictions on particular products.

Unless stated otherwise, discount codes cannot be exchanged for cash or applied retrospectively. We may withdraw or correct a promotion where there has been an obvious error, misuse or fraud.

  1. OUR RESPONSIBILITY TO YOU

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products sold through this website are intended for personal use. We are not responsible for business losses, loss of profit or loss of business opportunity arising from consumer use of the products.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, carrier disruption, industrial action, interruption of essential services or disruption affecting a fulfilment facility.

If such circumstances cause a significant delay, we will contact you where reasonably possible and take appropriate steps to minimise the effect. Your statutory cancellation and refund rights remain unaffected.

  1. PRIVACY

We process personal information in accordance with our Privacy Policy. Information necessary to produce and deliver your order will be shared with relevant service providers, including our payment, fulfilment and delivery partners.

  1. COMPLAINTS

If you are unhappy with a product or our service, please contact:

Please include your name, order number and a clear description of the issue. We will aim to acknowledge and resolve complaints within a reasonable period.

  1. CHANGES TO THESE TERMS

We may update these terms occasionally. The terms applying to an order will be those made available when the order was placed.

  1. GOVERNING LAW

These terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you will retain any mandatory consumer protections that apply where you live. You may bring proceedings in the courts covering the part of the United Kingdom in which you live.
